Terms of Service
These terms describe expected usage of Fashionate. By accessing or using the service, you agree to be bound by these Terms and our Privacy Policy.
1. Agreement to Terms
By accessing or using Fashionate, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to all of these terms, do not use our services.
You must be at least 18 years old to use Fashionate. By using the service you confirm you meet this requirement.
2. Service Intelligence
Fashionate provides AI-driven wardrobe management tools. While we strive for precision in auto-tagging and styling recommendations, results are generated by artificial intelligence and should be viewed as creative suggestions.
3. User Content
You retain all rights to the images you upload. By uploading images to our platform, you grant Fashionate a limited, non-exclusive license to process these images for the sole purpose of providing our styling and archival services to you.
4. Acceptable Use
You may not upload inappropriate, explicit, or non-clothing related content. Our AI vision pipeline automatically moderates uploads to ensure a professional styling environment.
5. Free & Paid Plans
Fashionate offers a free tier with core wardrobe management features. Paid plans (Pro, Elite) provide additional AI features, higher usage limits, and priority support. Plan details and pricing are available on our pricing page.
6. Subscription & Cancellation
Paid subscriptions are billed monthly or annually. To cancel your subscription, please email hello@fashionateai.com and we will process the cancellation within two business days. You retain access to paid features through the end of your current billing period, after which your account reverts to the free plan. No refunds are provided for partial billing periods.
UK & EU cooling-off period: Under the UK Consumer Rights Act 2015 and the EU Consumer Rights Directive (2011/83/EU), consumers in the United Kingdom and the European Union have the right to cancel a new paid subscription within 14 days of purchase for a full refund, provided substantial use of paid AI features has not yet occurred. Email hello@fashionateai.com with the subject “Cooling-Off Refund” within 14 days of your initial purchase.
7. Prohibited Uses
You may not use Fashionate to:
- Upload illegal, harmful, or explicit content
- Attempt to reverse-engineer our AI models or APIs
- Scrape or bulk-download data
- Impersonate others
- Use the service for any commercial resale purpose without written permission
- Violate any applicable laws or regulations
8. Intellectual Property & Data Ownership
You own all wardrobe data and images you upload to Fashionate. We do not claim ownership over your content. The Fashionate platform, its design, branding, AI models, and underlying technology are the intellectual property of Fashionate.
9. Limitation of Liability
Fashionate is provided “as is” without warranties of any kind. We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.
10. Governing Law
These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
11. AI-Generated Content
Fashionate uses third-party general-purpose AI providers (Anthropic Claude, Google Gemini and Imagen, Fal.ai) to generate outfit suggestions, shopping recommendations, try-on imagery and packing lists. AI-generated content is creative output, not professional styling, medical, or legal advice, and may contain inaccuracies.
In accordance with the EU AI Act (Regulation 2024/1689), you have the right to request human review of any automated decision that significantly affects you. Email hello@fashionateai.com with the subject “Human Review Request” and we will respond within 30 days.
12. Changes to Terms
We may modify these Terms from time to time. Material changes will be communicated to you by email at least 30 days before they take effect. Continued use of Fashionate after the effective date of any change constitutes your acceptance of the revised Terms.
